These Terms of Service ("Terms") govern your use of Retriv (the "app," "we," "us"), a study and flashcard app for iOS. By downloading, creating an account, or using the app, you agree to these Terms. If you don't agree, please don't use Retriv.
You must be at least 13 years old to use Retriv. If you are between 13 and the age of majority where you live, you may only use the app with the involvement of a parent, guardian, or teacher who agrees to these Terms on your behalf.
Retriv is not directed at children under 13, and we do not knowingly allow them to create accounts.
You are responsible for the security of your account and for everything that happens under it. Provide accurate information when signing up, keep your credentials private, and let us know promptly if you believe someone else has gained access.
You may permanently delete your account and all associated data at any time from Profile → Delete Account in the app.
You own what you create. Lessons, flashcards, custom decks, classroom announcements, your display name and profile photo — all of it remains yours. These Terms do not transfer ownership of your content to us.
You grant us a limited license to operate the app. To provide Retriv, you grant us a non-exclusive, worldwide, royalty-free license to store, reproduce, and display your content solely for the purpose of running the service for you and for the people you deliberately share it with — for example, displaying a lesson you shared into a classroom to the students enrolled in it. This license ends when you delete the content or your account, except for content others have already copied and backup copies that age out of our systems on their normal schedule.
You are responsible for what you upload. You represent that you have the rights to the content you put into Retriv, including any photos of notes, textbook pages, or slides you scan. Do not upload material you do not have permission to use. Copying substantial portions of a copyrighted textbook into shared classroom lessons may infringe the rightsholder's copyright, and that responsibility is yours, not ours.
Retriv lets instructors create classrooms that students join with a code. If you use this feature, the following applies.
What instructors can see. An instructor can see the roster of their classroom and each enrolled student's progress on lessons the instructor assigned — cards resolved, cards correct, and when the student was last active. Instructors cannot see a student's own private lessons, their activity in the built-in decks, or any study the student does outside assigned lessons.
Announcements. Only the classroom instructor can post announcements. Enrolled students can read them and can report any announcement they find objectionable.
Joining and leaving. Anyone with a join code can enroll, so treat join codes as you would any shared link. Students may leave a classroom at any time, and instructors may remove a student from their classroom at any time.
Instructor responsibility. If you create a classroom, you are responsible for the content you post and share into it and for how you use the progress data you can see. If you are using Retriv with students in an educational setting, you are responsible for having whatever consent your school, district, or local law requires.
Do not use Retriv to:
Retriv provides an in-app way to report objectionable classroom announcements. Reports come to us for review, and instructors can remove students from their classrooms.
We may remove content, suspend accounts, or terminate access — with or without notice — for conduct that violates these Terms or that we reasonably believe creates risk or legal exposure for us, other users, or third parties. We aim to be proportionate, but we do not guarantee that we will review every report or take any particular action.
Retriv's AI Smart Scan uses Google's Gemini API to generate questions and answers from photos you provide. This content is produced automatically and may be inaccurate, incomplete, or misleading.
You are responsible for reviewing AI-generated cards before relying on them. You can review, edit, or delete any generated card before saving it, and we encourage you to do so.
Retriv is a study aid, not an authoritative source. Do not rely on it as your sole source of truth for exams, coursework, certification, medical, legal, financial, or safety-critical information. We make no warranty that generated content is correct, and we are not responsible for academic, professional, or other consequences arising from errors in it.
Voice study mode uses Apple's Speech Recognition to convert your spoken answers to text, and Retriv then grades that text automatically. Speech recognition and automated grading are both imperfect — accents, background noise, and phrasing can all produce incorrect transcriptions or grades. Scores, streaks, and progress statistics are motivational features, not assessments of record.
Retriv depends on services operated by others, including Firebase (Google) for authentication, Supabase for data storage, Google's Gemini API for AI Smart Scan, and Apple's Speech Recognition. Your use of Retriv is also subject to those providers' terms. We are not responsible for their availability, performance, or acts and omissions.
Retriv is provided as-is and may change. We may add, modify, or remove features, and we may suspend or discontinue the app in whole or in part at any time. We will try to give reasonable notice of a discontinuation where practical, but we do not guarantee it. We do not guarantee any particular level of uptime, and study data can be affected by outages at the third-party services above.
Retriv is currently offered free of charge and contains no in-app purchases or subscriptions. If that changes, we will update these Terms and give notice before charging you anything.
You may stop using Retriv at any time and delete your account from Profile → Delete Account. We may suspend or terminate your access as described in Reporting and Enforcement. Sections that by their nature should survive termination — including Your Content (as to licenses already granted), Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — survive.
To the fullest extent permitted by law, Retriv is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the app will be uninterrupted, secure, or error-free, that defects will be corrected, or that content in the app — including AI-generated study material and automated grading — is accurate or reliable.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, study progress, profits, goodwill, academic standing, or educational opportunity, arising out of or relating to your use of Retriv — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to Retriv will not exceed the greater of (a) the total amount you paid us for the app in the twelve months before the claim, or (b) twenty-five US dollars (US $25.00).
Some jurisdictions do not allow the limitation or exclusion of certain damages, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless Retriv and its developers from any claims, damages, losses, liabilities, and reasonable legal fees arising out of your content, your use of the app, your violation of these Terms, or your violation of any law or third-party right — including claims brought by students, parents, or schools relating to a classroom you operate.
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction — except where the law of your home jurisdiction gives you a non-waivable right to bring the dispute elsewhere.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where the change is significant we will make reasonable efforts to notify you in the app. Continuing to use Retriv after a change means you accept the updated Terms.
